EB2-NIW  FILING ASSISTANCE

This checklist is intended for individuals with approved employment-based visa applications, who are preparing to interview for their visa stamps at the U.S. Embassy in their home country.

Things to work on first:

• Copy of the Intending Immigrant(s)’s Birth Certificate
• Color copy of the Intending Immigrant(s)’s Passport Biographic Page and all stamped pages of Passport
• 2 Passport-style photographs of the Intending Immigrant(s). Photo Requirements.
• Copy of Police Certificate(s) from each country where the intending immigrant(s) has lived for more than one year, except the U.S.*

Documents to be ready to submit at the Embassy interview:

• Original Birth Certificate for the Intending Immigrant(s)*
• Original Marriage Certificate for the Intending Immigrant(s), if applicable*
• Original Divorce Certificate(s) for the Intending Immigrant(s), if applicable*
• Original Police Certificate(s) from each country where the Intending Immigrant(s) has lived for more than one year, except the U.S.*
• Original Military Records for the Intending Immigrant(s), if applicable*
• Original Court/Prison Records for the Intending Immigrant(s), if applicable*

PLEASE NOTE: If a document is not in English, then a certified translation is required. Our firm can order a translation for you at an additional cost, or you can have your document translated and certified using a translation certification statement, signed, and notarized. You may not translate your own documents, nor those of any family member. Please submit certified translations for all foreign language documents. Outline of the Process: Employment-based Consular Processing

1. The I-140 Immigrant Petition for Alien Worker: The I-140 petition will be filed with the U.S. Citizenship and Immigration Services. Once the I-140 Petition is approved, the case will be sent to the National Visa Center for further processing.
2. Fee Bill Packet: This packet should arrive 3-8 weeks after the I-140 Petition is approved. It will require payment of the Immigrant Visa fees for the Intending Immigrant (s). If the Intending Immigrant wishes to bring immediate family members to the United States, s/he should add them to his/her Immigrant Visa Petition at this time.
3. Instruction Packet: When visas are available, we will receive the NVC “Instruction Packet.” This packet will request an online form from the Intending Immigrant(s) and copies of documents.
4. Notification of Interview: When the NVC has gathered and reviewed all forms, photos, and original documents for the Intending Immigrant(s), they will schedule an interview at the U.S. embassy in the Intending Immigrant(s)’s home country. The final stage of the Immigrant Visa application will be processed at the embassy. If the application is approved, the Intending Immigrant(s) will receive an Immigrant Visa stamp on his/her passport. S/he will then have six months to move to the United States.

Do not send us original documents. You should send us copies or scans of your items and keep the originals in a safe place. If you have sent us an item already, you do not need to send it again. Just let us know if you’ve already sent it.
